These are the terms and conditions for The Circle Wine Company. Registered address; 47 Chesilton Road, London. SW6 5AA. Our Company Registration Number is 5475463. These terms apply to all sales and will apply unless varied in writing by The Circle Wine Company Limited.
1) Prices
Unless indicated to the contrary, prices on our website are per case or per 75cl bottle, exclusive of Duty and VAT, exclusive of delivery charge and correct at the time of publication so may be subject to fluctuation. All orders are subject to written confirmation by The Circle Wine Company Limited
2) Payment
Payment is due on invoice unless otherwise agreed in writing by The Circle Wine Company Limited and can be made by bank transfer, UK cheque or certain debit cards. We can also accept credit cards but there is a surcharge of 2.5%. We do not accept payments in cash unless specifically agreed. If payment is overdue, The Circle Wine Company Limited are entitled to; suspend collections and deliveries, retain possession of any goods to which you would otherwise be entitled and charge an interest rate from the date that payment was due of 5% per annum above the base rate from HSBC Bank. Title of goods remain with The Circle Wine Company Limited until fully paid for.
If payment is overdue and/or delivery/collection instructions have not been received by The Circle Wine Company Limited within 30 days of notification to a customer that the goods are available, The Circle Wine Company Limited has the right to send written notice to the invoice address that the title of the goods will return to The Circle Wine Company Limited. If The Circle Wine Company Limited are able to resell the goods then 80% of the net proceeds may be returned to the customer who was originally invoiced.
3) Orders
In the unlikely event that we are unable to supply wine that has been purchased by a customer, The Circle Wine Company liability is limited to returning any monies paid to us for wine not supplied. All orders placed are conditional upon our confirmation in writing via invoice. The Circle Wine Company Limited reserves the right to not split cases unless specifically agreed in writing.
4) Delivery and Acceptance of Wine
The Circle Wine Company Limited deem that wine has been received in an acceptable condition with no shortage or other deficiency once a delivery has been signed for or after a period of 48 hours has elapsed from the time that the wine was delivered. Thereafter a customer will not be entitled to return or reject wines. A storage charge will be payable (at our current rate) on all wines that are not collected or delivered within one month of notification that they are in stock.
Private individuals who purchase more than 11 bottles of wine can have the wine delivered anywhere in England or Wales at no charge.
5) Description and Quality of Goods
Whilst The Circle Wine Company Limited aim to accurately describe wines and act in good faith when purchasing and storing goods, we will not be deemed responsible for the condition of wines or whether they have the qualities anticipated from descriptions provided by The Circle Wine Company Limited. Replacement of goods will be at the discretion of The Circle Wine Company Limited.
6) Use of our website and links to other websites
Use of this website is entirely at your own risk. We do not sell to persons under the age of eighteen years and this website should not be used by them. The Circle Wine Company Limited's website may include links to other websites but this does not signify that we endorse these websites and we do not take responsibility for the content of such websites. Links may not be made to this website without the prior consent in writing from The Circle Wine Company Limited.
7) Force Majeure
The Circle Wine Company Limited will always aim to meet our obligations but will not be held responsible for acts beyond our control
8) Applicable Law
All of our contracts and the use of our website are subject to the laws of England and are subject to the exclusive jurisdiction of the English Courts.
